In Spain, Organic Law 2/2010, modified by Organic Law 1/2023, regulates sexual and reproductive health and the voluntary termination of pregnancy. Care must be provided by professionals or under their direction and in an accredited public or private healthcare centre.
Interruption at the woman's request
The law allows pregnancy to be terminated at the woman's request within the first 14 gestational age. Since the 2023 reform, the mandatory three-day reflection period no longer exists. Consent must be free, informed and expressed in writing before the intervention.
Assumptions for medical reasons
Until week 22, the law contemplates interruption when there is a serious risk to the life or health of the pregnant woman or risk of serious anomalies in the fetus, with the required medical opinions. There are also exceptional cases related to fetal anomalies incompatible with life or extremely serious and incurable diseases, which require the legally provided assessment procedure.
Minors
Young women aged 16 and 17 can themselves give consent for the voluntary termination of pregnancy in accordance with current regulations. Below that age, the rules of consent for representation and protection of the minor apply. In the event of any family or vulnerability situation, request individual guidance.
Privacy, information and access
The law protects the privacy and confidentiality of data. It also recognizes the right to receive accessible information about the procedure and the benefits available.
